1. SCOPE OF APPLICATION

1.1

These General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed with us (ABUS UK Ltd, Unit 30 Portishead Business Park, Old Mill Road, Portishead, Bristol, BS20 7BX) via our online shop page  keyservice-uk.abus.com (hereinafter also "Online Shop").

1.2

A consumer is any natural person who enters into a legal transaction for purposes which are predominantly neither commercial nor self-employed.

1.3

Business is a natural or legal person or a partnership with legal capacity who acts in the course of a legal transaction in the exercise of their commercial or independent professional activity.

2.  PRICES, SHIPPING COSTS, DELIVERY CONDITIONS

2.1

For orders in our online shop, the prices quoted in the offer at the time of order apply. The indicated prices are final prices in GBP Sterling, that means they contain all price components as well as the legal Value Added Tax of 20%. The delivery time is, unless otherwise stated in the offer, 2 to 5 working days. We charge no additional costs for using the payment methods.

2.2

There is a post and packaging fee of £4.99 this includes shipping to Highlands and Islands.

2.3

If all products ordered are not in stock, we are entitled to partial delivery at our expense, as far as this is reasonable for you. If the ordered product is not available because ABUS was not supplied with this product by its suppliers through no fault of their own, ABUS can withdraw from the contract. In this case, ABUS will inform you immediately and, if necessary, propose the delivery of a comparable product. If no comparable product is available or you do not wish to receive a comparable product, ABUS will reimburse you immediately for any compensation already paid.

 

 

3.  CONCLUSION OF CONTRACT, CONTRACTUAL LANGUAGE

3.1

The presentation of the articles in our online shop does not constitute a legally binding offer, but an invitation to the customer to make us a binding offer. You can check your entry again on our order page. By clicking on the button "Buy" you conclude the order process. With this you have placed a binding order. The process can be cancelled at any time by closing the browser window. On the individual pages you will find more information, such as correction options. After submitting your order in the online shop, you will automatically receive an e-mail that documents your order (order confirmation). 

3.2

A binding contract can be concluded as follows, depending on the chosen payment method:

  • If you have chosen the payment method credit card, the contract is concluded at the time of the credit card debit.
  • If you have chosen the payment method PayPal, the contract is concluded at the time of your confirmation of the payment order to PayPal.

3.3

The contract is concluded exclusively in English. We only conclude contracts with customers who have reached the age of 18.

4.  PAYMENT

4.1

The payment of the goods takes place by PayPal. 
ABUS reserves the right to exclude certain payment methods in individual cases.

4.2

Payments are made via PayPal (Europe) S.à.rl & Cie. SCA, 22-24 Boulevard Royal, 2449 Luxembourg, Luxembourg

We pass your payment details to PayPal as part of the payment process. The disclosure is made in accordance with Art. 6 para. 1 lit. f GDPR and only insofar as this is necessary for the payment process. For further data protection information, please refer to the privacy policy of PayPal:   https://www.paypal.com/webapps/mpp/ua/privacy-full

You can object to this processing of your data at any time by sending a message to PayPal. However, PayPal may continue to be entitled to process your personal data if this is necessary for the contractual payment process.

 

5.  RIGHT OF WITHDRAWAL

Consumers have a right of withdrawal.

You have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the last goods. To exercise your right of withdrawal, you must contact us (ABUS UK Ltd, Unit 30 Portishead Business Park, Old Mill Road, Portishead, Bristol, BS20 7BX: +44 (0) 117 204 7000 email:  mobilesecurity@abus-uk.com ) by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract. 

To maintain the withdrawal period, it is sufficient that you send the notice of exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the cancellation

If you withdraw from this Agreement, we will provide you with all payments we have received from you, including delivery charges (excluding any additional costs), which may result from your providing a different delivery method than the best standard delivery we offer have chosen to repay immediately and at the latest within fourteen days from the date on which the notification of your revocation of this contract has reached us. For this repayment, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you; In no case will we charge you for these repayments. We can refuse the repayment,

You must return the goods to us immediately and in any event not later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You bear the immediate costs of returning the goods.

You only have to pay for a possible loss in value of the goods, if this loss of value is due to a handling that is not necessary for the examination of the nature, characteristics and functionality of the goods.

End of revocation

Exclusion of the right of withdrawal

The right of withdrawal does not apply to the following contracts:

  • Contracts for the supply of goods that are not pre-fabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

We do not grant business customers a right of withdrawal.

6.  OWNERSHIP

The goods remain the property of ABUS until full payment.

7.  DISPUTE RESOLUTION PROCEDURE

The European Commission provides an online dispute resolution (OS) platform it operates. The platform can be found at  http://ec.europa.eu/consumers/odr/

ABUS is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

8. WARRANTY

8.1

The statutory warranty provisions apply insofar as there are no deviations from the following regulations. The statutory warranty claims expire after two years. Proof of purchase is required for all warranty claims. 8.2

If the customer buys as a business, the claims under the statutory warranty provisions expire in one year.

8.3

Excluded from clauses 8.2 and 8.3 are claims for injury to life, body or health that are based on a negligent breach of duty by ABUS or a wilful or negligent breach of duty by a legal representative or vicarious agent of ABUS.

8.4

The statutory warranty claims of the customer remain unaffected in the case of the existence of a guarantee for the ordered goods.

9. LIABILITY

9.1

Customer claims for compensation are excluded. This does not apply to claims for damages of the customer resulting from injury to life, limb or health, as well as liability for other damages that are based on an intentional or grossly negligent breach of duty by ABUS, its legal representatives or vicarious agents. Furthermore, the liability for the breach of obligations, the fulfilment of which makes the proper execution of the contract possible in the first place and on the compliance of which the customer may regularly rely remains unaffected. In the case of slightly negligent breach of these contractual obligations, ABUS shall only be liable for the contractually typical, foreseeable damage, unless it concerns claims for damages of the customer resulting from injury to life, limb or health.

9.2

Para. 9.1 shall also apply in favour of the legal representatives and vicarious agents of ABUS, if claims are asserted directly against them.

9.3

The provisions of the Product Liability Act remain unaffected.

10. FINAL PROVISIONS

In addition to entrepreneurs:

10.1

Should one or more of the above conditions be or become ineffective or contain a gap, the remaining conditions shall remain unaffected.

10.2

For all disputes the law of the United Kingdom applies exclusively. The provisions of the UN Sales Convention (CISG) do not apply.

10.3

Jurisdiction for all disputes is our seat of business.
